By paying the booking payment for a session, you confirm that you have read, understood and agreed to the terms below. If a separate signed agreement has been made for your booking, that agreement takes priority where it differs.
-
Booking payment. A 50% booking payment (deposit) is required to confirm your session. Your date and time are reserved only once it has been received; until then they remain available to other clients and may be offered to someone else without notice. Paying the booking payment confirms your acceptance of these terms. For bookings made shortly before the session, full payment may be required upfront.
Balance. The balance is due on the day I deliver your watermarked, view-only preview gallery. Your high-resolution and web-resolution files are released once the balance has been received in full. Final files are not released while any amount is outstanding.
Payment method. Payment is made by PayNow. Payment details are provided when you book.
Prices. All prices are in Singapore Dollars (SGD). I am not GST-registered, so no GST is charged. Prices may change without notice, but the price confirmed at the time of booking is the price that applies to your booking. Additional images, hours, videos, locations, travel or other services requested after booking are charged separately.
Refunds. Because your date is reserved and the work is carried out for you, refunds are not provided once the session has taken place. This includes dissatisfaction with appearance, poses, outfits, weather or other subjective aspects of the photographs, provided I have delivered the agreed scope of service. I will address genuine technical issues and reasonable re-edit requests as set out under Images & Editing.
-
Client cancellations. The booking payment is non-refundable if you cancel. If you cannot attend, you may request a postponement under the terms below.
Postponements. One postponement to a mutually agreed date is included at no charge if requested at least 7 days before the session, subject to my availability. Requests made with less than 7 days’ notice may incur a rescheduling fee of S$100. Postponements due to illness, emergency or unsafe weather are considered case by case and may be exempt from the fee. A second postponement may be treated as a cancellation, in which case the booking payment is forfeited, unless it is due to illness, emergency or unsafe weather. A new date is confirmed only once we have agreed it in writing (message or email).
No-show. If you do not attend the session without prior notice, the booking is treated as a no-show and the booking payment is forfeited. A new booking requires a new booking payment.
Photographer cancellation. If I am unable to conduct your session due to illness, emergency or circumstances beyond my reasonable control, I will offer to reschedule to a mutually suitable date or arrange a skilled replacement photographer. If neither is possible, all payments received for the session will be refunded. I am not responsible for any other costs you have incurred, such as travel, makeup, styling or accommodation.
-
Preparation and late arrival. Please arrive on time and prepared, with your outfits, makeup and personal belongings, and allow time for travel, parking and changing. A late arrival does not entitle you to extra shooting time or a refund for the time lost; the session ends at the originally scheduled time. If extra time is available, you may request an additional hour at the add-on rate. You are responsible for your own belongings during the session.
Travel. Locations further out, such as Sentosa, Tuas, Woodlands or Changi, are quoted separately. For sessions with several locations, travel between locations is agreed in advance.
Locations, permits and venues. Entrance fees, photography permits, parking and other venue costs are your responsibility unless stated otherwise. You are responsible for obtaining permission to photograph at the chosen venue.
Art events and artworks. For exhibitions, events and artwork documentation, the client (or organiser) is responsible for informing guests, artists and venue staff that photography will take place, and for confirming that they are entitled to have the artworks photographed. Copyright in the artworks themselves remains with the artist and is not affected by the photographs.
Weather. For outdoor sessions, heavy rain, lightning, haze or other conditions that make the session unsafe or significantly affect image quality may require postponement. I will discuss this with you as early as reasonably possible.
Additional participants. Please tell me as soon as possible if the number of people changes after booking. A package upgrade or an adjustment to the fee may be required, including if people are added on the day.
-
Images and delivery. Your package includes the stated number of edited images, selected and edited by me. A watermarked, view-only preview gallery is generally delivered within 7 days of the session; for larger sessions or events I will confirm the timeline in advance. After the balance is paid, high-resolution and web-resolution downloads are released. Additional edited images can be purchased at the add-on rate.
Editing and retouching. All delivered images receive my standard professional colour editing and natural, basic retouching, such as minor blemishes, small distractions and stray hairs. I keep retouching authentic and do not alter permanent or defining features. Extensive retouching, body reshaping, facial alterations or heavy object removal may be declined or quoted separately.
Video. Video add-ons follow the same terms for delivery, editing, gallery storage and copyright.
Raw files. Raw or unedited files are not provided. Editing is part of my creative process, and unedited files do not represent my finished work.
Gallery storage. Your gallery is available for 30 days from delivery. You are responsible for downloading and safely storing your images within this period. After it ends, I may permanently delete the files and cannot guarantee that they can be recovered.
-
Copyright. Under Singapore’s Copyright Act, the creator of a photograph or film owns the copyright by default, even when it was commissioned, unless the parties agree otherwise. Copyright in all photographs and videos created during your session remains with me, the photographer. This is not transferred to you, and it is not changed by delivery or payment.
Your use of the images. Once the balance is paid, you receive a licence to use your high-resolution and web-resolution images for personal and non-commercial purposes, including printing, sharing with family and friends, and posting on social media and personal websites. Artists, galleries and organisers may also use the images to promote their own work, exhibition or event, for example on a website, on social media and in press materials. Please credit Valentina Conchie Photography when sharing images publicly; creators are entitled to be identified as the photographer when their work is used publicly. Please do not edit, filter or crop the images in a way that changes their character or misrepresents them.
Commercial use. Publishing, licensing or selling the photographs for profit, for example in advertising, merchandise, stock or resale, requires my prior written permission and may be subject to a separate licence fee.
My use of the images. I may use photographs and videos from your session in my portfolio, website, social media, advertising, marketing, competitions, publications and exhibitions. If you have privacy concerns or do not want certain images used publicly, please tell me before the session. For sessions involving minors, a parent or guardian must make the booking and may raise any privacy concerns in advance.
-
Limitation of liability. I take great care with exposure, transport and processing, and I use professional equipment with professional backup. If images are nevertheless lost, stolen or destroyed for reasons within or beyond my control, my liability is limited to a refund of the payments received for the session, or a proportionate amount in the case of partial loss. I take every care to capture the important moments, but I cannot guarantee specific shots or moments, particularly at live events. I am not liable for loss of or damage to personal items. Nothing in these terms limits any rights you have under Singapore law that cannot be excluded.
Third-party clearances. You are responsible for obtaining any permissions, clearances and insurance required for your session, venue or event, and for third-party rights in anything you ask me to photograph. You agree to cover claims, costs and expenses that arise from a failure to obtain them.
Events beyond my control. I am not responsible for failure to perform caused by events beyond my reasonable control, such as severe weather, floods, government restrictions, strikes, power failure or public health measures. In that case we will agree a new date, or I will refund the payments received if that is not possible.
Privacy. I use your personal details only to manage your booking and deliver your images, and I do not share them without your consent, except where required by law.
Third parties. A person who is not a party to your booking has no right to enforce these terms under the Contracts (Rights of Third Parties) Act.
Changes and disputes. Changes to a booking are agreed in writing (message or email is fine). If a dispute arises, we will first try to resolve it by discussion and then, if needed, by mediation, for example through the Singapore Mediation Centre. This does not prevent either of us from bringing a claim to the Small Claims Tribunals where it applies. These terms are governed by the laws of Singapore.
